Are Apartments with Penthouse eligible for Occupancy Certifc

Hi,
I saw a ready to move in apartment near whitefield. SBI is offering a loan for this apartment (there are 8 units for whom SBI had already sanctioned the loan). There are only two unit left and I looking to buy one of them.

Situation:
The builder has built two units (flats) for himself and land owner has built a penthouse (an area worth of two units). Looks like this had happened at the end of the construction.The land has A-Khata and the builder seems to stick to the plan on other aspects except the penthouse & two units on terrace. In terrace they do have other common amenities like Gym, Club house.

Question:
1) Is it possible to get an occupancy certificate and A-Khata for this unit?
2) Is it possible to get an (re)approval for penthouse (after deviating from the original issued plan?
3) Will this cover under Akarma-Sakarma. The project commenced on June 2013. How I should go about now? Whether to proceed or not.
4) Is it worth rising taking this unit on the basis of Akarma-Sakarma if OC won't be given due to these deviations? My confusion here is there are other owners who got moved in and started living. Wondering what would have made them to take the risk of moving without OC?
