My grandfather owned 40 X 110 site in Basavanagudi. My father and two of my uncles passed away before the paritition case was decided by our courts. My brother/my self and my mother got 1/3rd share of the property ( 30 X35). I relinquished my share to my brother as he had a young family. My mother kept her share . My brother somehow built three floors he lives in one and has rented out other two floors. I no longer stay in India my mother stayed with me and now she is 85 years old. We have asked my brother to give her share of the property which he refuses. I have no idea how the khatha stands in his name as my mother is also the joint owner. If i want to find out how khatha got registred under my brothers name what I should do. If the partition deed has my mothers name can she petition the BBMP to include her name on the khatha as she is the legitimate owner. Please guide me
