Difference between BDA layout and BDA approved Layout

Hi,

I just wanted to know the difference between BDA formed Layout and a BDA approved Layout.
When we go for document verification here, Do we need to get EC for only from the period the Layout is formed or for the earlier period also?

And when we go for loan to buy such property, the current BDA khata and A khatha should be in present owner's Name?

Your valuable inputs will help a lot.

Dear mahan,
You have sought for three clarification which are answered accordingly here under:-

1. difference between BDA formed Layout and a BDA approved Layout.

If the state( BDA) acquires the land under section(1) and 6(1) of L A Act, forms layout,then that will be BDA formed layout. In the said layout once property acquired by statutory authority, all private interests will be seized, if at all anybody is having any interest,they should work it out in the compensation amount.

If any private person or builder purchases and get approve project with BDA by following the guidelines,then that will be BDA approved layout. In such cases the BDA approval is only technical approval and they don't go into the title of the property. therefore, purchasers have take care of the tile of the property by verifying the flow of title with relevant documents.

2. Reg EC : Normally EC from that of formation of layout is enough, if you desire, you can apply for any number of years.
3.it is mandatory as per the Registration act, Khata should be in the name of the Seller. But in some cases,the developers will get khata directly in the name of Purchaser in order save money after excuation of sale deed.

Thanks Murali for a detailed information.
Regarding Khatha from BDA and BBMP(A Khata) in this case - If seller has not yet transferred it to his name from his previous seller yet and the current buyer is going for a loan, then Bank will accept it?

IF the seller doesn't have khata in his name at the time of selling, I don't think even sub registrar will accept deed for registration.

Bank will not grant loan, if seller doesn't have khata in his name under normal circumstances.
