It is menat for only BCCHS layout. As my information goes , it is not only this court case is problem. There are other cases pending for judgement in High Court . Depending on this judgement there is every possiblity that these cases might be adversely effected to the site owners.

It is only for BCCHS Layout. There are other court cases pending in high court for judgement which might effect the site owners.

Happy if the Supreme Court judgement clearly pertains only to the survey numbers mentioned in the BCCHSL newspaper public notice (7/1, 8/1, 49 and 50/2) but can any one show where exactly it says so (page and paragraph number) in the judgement? I have the 36 page judgement. Thanks.

BCCHS and BDA, having registered the sale deeds, collected registration fees and taxes, issued possession certificates, khatas, cannot ask us to return our sites. The court has directed the BCCHS to return certain land to the owners for whatever reason and the BCCHS Public Notice (I hope their lawyers know what they are talking) clearly says the the judgement pertains to certain survery numbers and the site owners need not worry. It is now upto the BCCHS to comply with the court order. The site owners have not been a party to the proceedings. However, as affected parties we can independently take the case to the Government to do something about it. Since it is likely that all housing societies use similar processes (objected to by the court) the Government has to find a way to regularise the matter.

Hi Srinath,
are you talking about which society site owners?

is BCC verdict will applicable all society site owners in future? because again those farmers whi gave land to develop the layout started fighting on the same ground.

Hope govt and court will not create any panic situation for the site owners and those who are having their house in the society layouts in bangalore.

is any court case pending against BCMC Layou?

Nearly 20 site owners are meeting at Madhavan park, Jayanagar on sunday 10th, feb. Every one who are interested can join us. Nearly 20 site owners have already informed about their participation.

hi apnagu,

I cannot say whether it is applicable for all the society created layouts. But this judgement will effect the full layout of BCCHS even though not by the present supreme court judgement but refering this judgement other land owners can file a suite for claiming the aquired land. It is a penodrs box opened for further litigations for BCCHS layout.

Hi ,
is somebogy got loan from bank while buying land/site in BCC Layout?
if yes what will bank do if site owners stop paying EMI ,In case if they loose their land.
so bank should also do complete legal verification before start offering loan to buy sites in banaglore.
we educated illterate ppl we always believe in banks for getting legal opinion,even if ask lawayes they are always giving opinion based on the papers which we are showing to them.
there is no clear cut guideline to get legal opinion for the property in bangalore city now a days.if ur having proper BDA Katha or bbmp a katha also we are ending up with the problem.
I think govt should do something for getting legal opinion on property otherwise we shud always ending up with such situtaion in future as well.

The only soution is Govt shud ban society to form layouts and cheating educated illetarate ppl like us.

These blogs, opinions, arguments and suggestions can go on. Whether the Supreme Court judgement pertains only to the land of the two respondents mentioned or, as the rest of the judgement discusses, the whole of the 200-odd acres is a moot point. Even if the former is accepted, the Government needs to act through their police force to protect the properties of the lawful owners because the real estate hawks can instigate the miscreants to continue to cause trouble. Someone can also file a case in the court and the matter becomes subjudice for a decade. As pointed out by some members, the grounds on which the Supreme Court ruled thus may be valid for all the sites purchased through several other housing societies who all adopted similar methods; that will make the situation messier for the whole of Bangalore. Since BDA (now BBMP) has registered sale deeds, issued the Khatas and collected the fees and taxes, it should do everything possible to protect the properties of the Khata holder and regularize the whole issue. The Government, which the BDA (BBMP) is a part of, should immediately issue an ordinance that the khata holders are the real owners and use the police to prevent unlawful elements from disrupting the building activity. I don't see any other solution.
